In order to clarify whether Rawls is more or less cosmopolitan than Kant, we carry out a comparative analysis between his general proposals for the organization of international relations. Likewise, seeking to clarify the distance between cosmopolitanism, pacifism and ius internationalism, the ius ad bellum proposals of both authors are particularly analyzed in the war-and-peace debate context. On the one hand, as a result of the first analysis, different commonly unnoticed logical coincidences between the postulates of Kant and Rawls are (...) highlighted. On the other hand, after the conclusions of the second analysis and taking as a criterion the causes that both authors admit as just for war, a proposal of an ideal type of cosmopolitan ius ad bellum is also provided. Las Instituciones Nacionales de Derechos Humanos cumplen, fundamentalmente, con dos funciones: proteger a las personas a partir de recomendaciones, garantizándoles una reparación si se comente una violación a sus derechos, y prevenir futuras violaciones a los derechos humanos. Sobre esta base están llamadas a ser los organismos que guíen hacia una cultura ciudadana a favor de los derechos humanos. Para lograr la culturización en este campo, se requiere educar en derechos a través de la educación formal e informal. En el (...) caso de México, la Comisión Nacional de los Derechos Humanos es la institución encargada de realizar esta labor. Su posición flexible y dinámica, así como su autonomía dentro del Estado mexicano, le dan la posibilidad de propiciar esa cultura, ya que es una institución de configuración diferente al sistema tradicional de impartición de justicia, por lo que hace que mantenga una línea de investigación enfocada en los derechos humanos. La culturización empieza por el ámbito nacional o interno y se debe extender hacia el exterior, como un movimiento social internacional. (shrink)

Se le hatildado de ateo, rebelde, mal hablado; pero se olvida que fue un místico que buscó llegara una comunión con la Intimidad, un hombre amante de la vida; se olvida sulabor de maestro de escuela que quiso formar hombres auténticos, sacándolos de suvida de rebaño y dándoles el lugar que se merecen. El presente trabajo tiene como objetivo,a partir de la lectura de algunas de sus obras, (...) indagar sobre el pensamientoantropológico y educativo del maestro Fernando González Ochoa. Presento al lector alFernando González que encontré a lo largo de mi lectura de sus obras y del diversomaterial consultado para este trabajo. María José Rincón González nació en Sevilla (España) y reside en República Dominicana desde 1992. Es miembro de número de la Academia Dominicana de la Lengua (ADL) desde el 2011 y directora del Instituto Guzmán Ariza de Lexicografía. Asimismo, es miembro correspondiente de la Real Academia Española (RAE) y miembro del consejo asesor de Fundéu Guzmán Ariza. Con respecto a su formación superior, es doctora en Filología por la Universidad Nacional de Educación a Distancia (UNED) y máster en (...) Lexicografía por la Universidad de Sevilla y la UNED. Ha participado en congresos internacionales y ha contribuido en las ediciones de diccionarios del idioma español. Are risk preferences stable over time? To address this question we elicit risk preferences from the same pool of subjects at two different moments in time. To interpret the results, we use a Fechner stochastic choice model in which the revealed preference of individuals is governed by some underlying preference, together with a random error. We take cumulative prospect theory as the underlying preference model (Kahneman and Tversky, Econometrica 47:263–292, 1979; Tversky and Kahneman, Journal of Risk and Uncertainty 5:297–323, 1992). (...) We observe that the aggregate pattern of preferences is very similar in both sessions, and it matches the results reported in the literature. Most subjects are risk averse for gains, and risk seeking for losses. However, the subjects that jointly agree with the reflection effect of prospect theory are around 50%. The percentage of individuals that change their responses across sessions is quite high, 63%. Estimating the stochastic choice model we find that 72% of the subjects have an underlying preference which agrees with the reflection effect of prospect theory. The remaining 28% are mainly classified as risk averse for both gains and losses. The results reinforce the empirical validity of the reflection effect. Deviations from the reflection effect can be attributed to noise, as well as to the existence of a fraction of risk averse subjects. (shrink)

We present an experiment in which we add a common delay in a choice between two risky prospects. The results show that delay produces the same change in preferences as in the well-documented common ratio effect in risky lotteries. The added common delay acts as if the probabilities were divided by some common ratio. Moreover, we show that there is a strong magnitude effect, in the sense that the effect of delay depends on the magnitude of the outcome. The results (...) are consistent with the recently introduced probability time trade-off (PTT) model by Baucells and Heukamp. We present a parameterization of the model based on the experimental results, showing that the value function exhibits increasing relative risk aversion, the weighting function is s-shaped, and the intrinsic discount rate is decreasing. The past decade has seen an explosion of work on calculi of explicit substitutions. Numerous works have illustrated the usefulness of these calculi for practical notions like the implementation of typed functional programming languages and higher order proof assistants. It has also been shown that eta-reduction is useful for adapting substitution calculi for practical problems like higher order unification. This paper concentrates on rewrite rules for eta-reduction in three different styles of explicit substitution calculi: λσ, λse and the suspension calculus. (...) Both λσ and λse when extended with eta-reduction rules, have proved useful for solving higher order unification. We enlarge the suspension calculus with an adequate eta-reduction rule which we show to preserve termination and confluence of the associated substitution calculus and to correspond to the eta rules of the other two calculi. We prove that λσ and λse as well as λσ and the suspension calculus are non-comparable while λse is more adequate than the suspension calculus in simulating one-step beta-reduction. After defining the eta-reduction rule in the suspension calculus, and after comparing these three calculi of explicit substitutions , we then concentrate on the implementation of the rewrite rules of eta-reduction in these calculi. We note that it is usual practice when implementing the eta rule for substitution calculi, to mix isolated applications of eta-reduction with the application of other rules of the corresponding substitution calculi. The main disadvantage of this practice is that the eta rewrite rules so obtained are unclean because they have an operational semantics different from that of the eta-reduction of the λ-calculus. For the three calculi in question enlarged with adequate eta rules we show how to implement these eta rules. For the λse we build a clean implementation of the eta rule and we prove that it is not possible to follow the same approach for the λσ and λsusp. (shrink)

This paper makes the claim that the overall structure of Plato’s Laws follows the principle of indirect access to the knowledge of human soul, which consists in the understanding that a philosophical approach to the soul is only possible initially through an image of it. The structure of the Laws can be interpreted as a movement towards the soul’s interior, beginning with the famous image of the puppet. According to this image, the movement opens with the analysis of the non-rational (...) elements of the soul, which are capable of an harmonic relation with the rational element, and advances bit to bit to the rational or epistemic element. The political necessity of undertaking the dialectical investigation in order to attain a philosophical knowledge of the human soul and its specific excellence appears only at the end of the dialogue. In this way, the structure of the Laws dramatizes the progressive birth of philosophy, conceived as the dialectical investigation of the unity of virtue, starting from the initial understanding of the human soul contained in the myth of the puppet. This paper argues that there is a thread in the philosophy of E. Tugendhat binding together his moral and justice theories with his conceptual analysis. Oriented by the thesis that a conceptual analysis is necessary to explain what justice is, this paper reconstructs some aspects of Tugendhat’s philosophy. It is divided in four sections: First, I delve into the author’s definition and use of conceptual analysis. Second, I describe some features of Tugendhat’s moral theory of contractualism. Third, I examine his (...) theory of justice. Fourth, I conclude by framing my analysis within the debate between Rawls’s and Tugendhat’s theories of justice. (shrink)

The search for mechanisms has been a common practice in scientific research. However, since the empiricist critique of causality, and especially during the second third of the twentieth century, other non-mechanistic perspectives—especially deductivism—gained predominance. But the sustained effort of authors such as Michael Scriven, Mario Bunge and especially Wesley Salmon contributed to restoring the respectability of causality and mechanisms in philosophy of science. Some members of the causal family, usually lumped under the name of “new mechanistic philosophy”, emphasize the description (...) of mechanisms, especially causal ones, as a central aspect of explanation and other research practices in several areas of science. This approach offers viable solutions to the various ontological and methodological objections that are opposed to the two traditional approaches. In this work the basic characteristics of three philosophies that highlight the description of mechanisms as a central element to explanation and their suitability for the science of ecology are discussed. Se explora la relación entre las dimensiones proposicional y no proposicional de la creencia religiosa para mostrar que la última dirige el proceso de justificación y representa su límite. Se defiende que la no proposicional también tiene valor cognitivo, porque constituye una suerte de elección epistémica preteórica que no es exclusiva de la fe religiosa. Se explora la noción de ambigüedad religiosa, tanto a nivel intelectual como experiencial, y se sostiene que la relación entre la dimensión proposicional y la no-proposicional (...) de la fe está mediada por la función directiva de las presuposiciones metafísicas instauradas por la experiencia religiosa. El presente artículo estudia las representaciones de mujeres con VIH/sida, en el libro Tiempos del SIDA. Relatos de la vida real, de Myriam Francis. El trabajo inicia con un análisis sobre la exclusión de los sujetos femeninos de la literatura “seropositiva” latinoamericana. Se plantea que las pocas representaciones que existen se enfocan en “mujeres sospechosas”, lo cual se repite, hasta cierto punto, en los textos de Francis seleccionados: “La última puerta”, “La viuda alegre” y “La chica alegre”. Luego, se ofrece (...) una explicación sobre el contexto en el que surgen las historias, un “pabellón-moridero” que se describe más bien como un espacio ameno, el cual, sin embargo, enfatiza la tragicidad que rodea a cada “caso”. Después, se estudian los tres relatos mencionados, en los que se mueven los símbolos primarios del mal (la mancilla, el pecado y la culpabilidad), de manera que una mujer es representada como una “víctima inocente” y otras, como “víctimas culpables” (fundamentalmente por sus “estilos de vida nocivos”). Finalmente, el trabajo concluye que la narrativa de Francis moviliza algunos principios de la “teoría de la degeneración”, para explicar las situaciones experimentadas por los personajes femeninos y ofrecer un mensaje didáctico-moralizante. This paper argues that the historical character of our knowledge is compatible with both ontological and epistemological realism. The first part critically analyses the thesis according to which the situated nature of our cognitive practices implies that they do not refer to an extra-linguistic reality. The second section explores the claim that realism is a necessary presupposition of our communicative practices and the final part outlines the principles of a pluralist realism.

In view of the question regarding whether post- secularization entails the mutual exclusion of religion and rationality, it examines the proposals of J. Habermas and N. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

The present research aimed to determine the Machiavellian orientations of tax administration auditors in Tunisia when faced with aggressive tax evasion strategies. To this end, we sent questionnaires to 119 executives of Tunisian tax authorities in charge of the tax auditing missions classified into three categories: central inspector, chief inspector and general inspector. The data were analysed using the structural equation method. Statistical results show that auditors from the tax administration, with weak Machiavellian orientations, ethically judge aggressive tax evasion strategies (...) and strongly believe in the importance of CSR. Thus, the results show that engagement in CSR practices plays a central role between the Machiavellianism of the tax authorities’ auditors and the dubious practices of tax evasion. The current study is the first attempt to analyse the effect of Machiavellian orientations of professionals and CSR practices on tax evasion in the Tunisian context. (shrink)

En aquest article pretenem fer una critica, des de postulats ètics de caràcter republicà, al mode actual d’entendre i, per tant, posar en practica el principi d'autonomia de la bioètica. Pretenem mostrar que, en l’estat actual d’aplicació d'aquest principi, emprant una definició liberal de llibertat i de la natura humana, aquest idea de llibertat i autonomia que es pretén protegir, no es compleix al deixar fora de l’equació tot un seguit de circumstancies socials, polítiques o econòmiques que poden dificultar al (...) pacient prendre una veritable decisió sobirana sobre quin ha de ser l’actuar dels professionals sanitaris sobre el seu cos en cada cas. Atendiendo al título de esta mesa, deseo centrar mi presentación sobre el estado de la cuestión en algunas reflexiones hechas desde la filosofía sobre el pluralismo en la política y, más concretamente, sobre el pluralismo en el espacio o esfera de lo público político. Para ello, asumiré, aquí, varias cuestiones: en primer lugar, asumiré que en las sociedades contemporáneas (de una modernidad tardía o postmodernidad) tiene sentido seguir hablando de esferas diferentes y, concretamente, de la esfera pública como una esfera (...) distinta a la esfera privada; en segundo lugar, asumiré lo público político como el espacio en el que tienen lugar los asuntos comunes, aquellos que nos interesan como comunidad política, y respecto de los cuales conversamos, deliberamos, decidimos y actuamos en nuestra condición de agentes o actores políticos; y, en tercer lugar, asumiré también el espacio de lo público político como un espacio de aprendizajes distintos, entre ellos, aprendizajes morales, aprendizajes éticos y aprendizajes de virtudes políticas. Women and amphorae: the epigraphy of Rhodian amphorae and the history of women in the Hellenistic world This article presents a selection of amphora stamps that mention Rhodian women. They come from different production and consumption centres in the Mediterranean, from the Black Sea to the Iberian peninsula. We show that one should not underestimate this source of evidence for the study of the conditions and economic rights of women in the Hellenistic world.

Norms have been widely enacted in human and agent societies to regulate individuals’ actions. However, although legislators may have ethics in mind when establishing norms, moral values are only sometimes explicitly considered. This paper advances the state of the art by providing a method for selecting the norms to enact within a society that best aligns with the moral values of such a society. Our approach to aligning norms and values is grounded in the ethics literature. Specifically, from the literature’s (...) study of the relations between norms, actions, and values, we formally define how actions and values relate through the so-called value judgment function and how norms and values relate through the so-called norm promotion function. We show that both functions provide the means to compute value alignment for a set of norms. Moreover, we detail how to cast our decision-making problem as an optimisation problem: finding the norms that maximise value alignment. We also show how to solve our problem using off-the-shelf optimisation tools. Finally, we illustrate our approach with a specific case study on the European Value Study. (shrink)

El presente artículo pretende analizar los efectos transformadores que la pandemia por Covid-19 ha obrado en nuestras existencias individuales y en nuestra convivencia social cotidiana desde la propuesta analítica del filósofo surcoreano Byung Chul-Han. Dicha transformación es de tal profundidad que, para nuestro autor, viene a exacerbar los males de la sociedad contemporánea, como el agotamiento y el cansancio por autoexplotación y permanente optimización de sí mismo propiciados por el neoliberalismo globalizado y omnipresente en Occidente. Desde esta constatación analizaremos en (...) particular cómo la prevalencia de la comunicación digital obligada por la emergencia viral trae consecuencias antropológicas que amenazan con eliminar lo esencial de la vida humana: la construcción de rituales, la estructura temporal cotidiana, el contacto corporal con los demás, la pertenencia a una comunidad y la apreciación de lo real en su genuina dimensión ontológica. Finalmente, exploraremos una posible salida a la alienación virtual en que forzadamente se encuentra la sociedad contemporánea. (shrink)

Coherentists fail to distinguish between the individual revision of a conviction and the intersubjective revision of a rule. This paper fills this gap. A conviction is a norm that, according to an individual, ought to be ascribed to a provision. By contrast, a rule is a judicially ascribed norm that controls a case and is protected by the formal principles of competence, certainty, and equality. A revision of a rule is the invalidation or modification such a judicially ascribed norm, provided (...) that the judge meets the burden of argumentation of formal principles. Thus, judges can revise their convictions without changing the law. (shrink)

For decisions whose consequences accrue over time, there are several possible techniques to compute total utility. One is to discount utilities of future consequences at some appropriate rate. The second is to discount per-period certainty equivalents. And the third is to compute net present values (NPVs) of various possible streams and to then apply the utility function to these net present values. We find that the best approach is to first compute NPVs of various possible income streams and then take (...) the utility of such NPVs. We show the drawbacks of other alternative models of evaluating income streams. The article discusses the advantages of the power and logarithmic forms in the modeling of time preference. These are the only forms for which utility of income and utility of consumption are strategically equivalent. Further, these forms permit the flexibility in the choice of a time period (e.g., monthly or quarterly) without modifying the utility function, thus simplifying analysis. (shrink)
